1. Acceptance of Terms

By downloading, installing, or using StreamSync ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. StreamSync is operated by StreamSync ("we," "us," or "our").

2. Description of Service

StreamSync is a desktop application that enables users to simultaneously stream live video content to multiple social media platforms (TikTok, YouTube, Instagram, Facebook) using RTMP technology. The App includes features such as product overlays, AI-powered comment analysis, and analytics tools.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use StreamSync. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

4. Account Registration

To access certain features, you must create an account. You are responsible for:

• Providing accurate, current, and complete information during registration
• Maintaining the security and confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

5. Subscription Plans and Payments

StreamSync offers tiered subscription plans (Starter, Pro, Enterprise) with varying features and pricing. By subscribing to a paid plan:

• You authorize us to charge the applicable subscription fees to your payment method
• Subscriptions automatically renew at the end of each billing cycle unless canceled
• You may cancel your subscription at any time through the billing settings
• Refunds are handled on a case-by-case basis; contact support for refund requests
• We reserve the right to change pricing with 30 days' notice to existing subscribers

6. Acceptable Use

You agree not to use StreamSync to:

• Violate any applicable local, state, national, or international laws or regulations
• Stream content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Infringe upon any third party's intellectual property rights
• Distribute malware, viruses, or any other harmful software
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App in any way that could damage, disable, or impair our servers or networks
• Violate the terms of service of any connected third-party platform

7. Third-Party Platforms

StreamSync integrates with third-party platforms (TikTok, YouTube, Instagram, Facebook, Shopify). Your use of these platforms through StreamSync is subject to their respective terms of service and privacy policies. We are not responsible for the actions, content, or policies of third-party platforms.

8. Intellectual Property

The StreamSync application, including its design, source code, features, logos, and documentation, is owned by StreamSync and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for its intended purpose.

9. Content Ownership

You retain ownership of all content you create, stream, or upload through StreamSync. By using the App, you grant us a limited license to process your content solely to provide the service (e.g., AI analysis of comments, analytics generation). We do not claim ownership of your content.

10. AI Features

StreamSync's AI features (buying signal detection, auto-reply suggestions) are provided as assistance tools. AI-generated suggestions are not guaranteed to be accurate, appropriate, or suitable for your specific use case. You are solely responsible for reviewing and approving any AI-generated content before sending it.

11. Data and Privacy

Your privacy is important to us. Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

StreamSync is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, StreamSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the App.

14. Indemnification

You agree to indemnify, defend, and hold harmless StreamSync and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App, violation of these Terms, or infringement of any third party's rights.

15. Termination

We may terminate or suspend your account and access to StreamSync at any time, with or without cause or notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or within the App. Your continued use after changes constitutes acceptance of the modified Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
